A federal judge Tuesday declared the Partial-Birth Abortion Ban Act unconstitutional, saying the measure infringes on a woman's right to choose.In her ruling, Judge Phyllis Hamilton wrote "The act poses an undue burden on a woman's right to choose an abortion". Perhaps she doesn't understand what partial-birth abortion actually involves. Kevin McCullogh gives a pretty detailed (and graphic) analysis here. (June 1 @ 2:19pm - Kevin needs permalinks badly.)The ruling applies to Planned Parenthood clinics and their doctors, who perform roughly half the nation's abortions.
If the mother's life is in danger, there is no way a doctor who is concerned about her health would recommend or perform this procedure. Instead he would rush her into surgery and perform a C-section. The only negative about that procedure (according to Planned Parenthood and their supporters) is that the child is almost always extracted in a living state.
With the birth control options available today followed by nine months of opportunity to legally choose to terminate an unborn child, banning the option to destroy a child within one inch of its (legal) life does not infringe on a woman's right to choose.
Planned Parenthood indeed.

Regarding partial birth abortion being “necessary” to save the mother’s life, here’s what I said back in November:
Newsflash: if the mother is about to die, why would you take the time to fire up the ultrasound (needed for finding the infant’s foot so it can be grabbed by forceps and yanked out), partially deliver the baby, jam the scissors into its skull, fire up the suction device, slurp out its brains, then crush its skull and complete the delivery? You WOULDN’T. If the mother’s life is in danger, and the baby needs to be out NOW, a doctor can literally perform an emergency C-section in 30 seconds. There is no circumstance when the mother’s need to kill her baby is greater than her need to live.

Actually, if you need an emergency c-section without damaging the mother’s internal organs, the best you can hope for is about 4 minutes to get the baby “clear” of the mother.
